By accessing and using ExpertSampling's website and services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services. These terms constitute the entire agreement between you and ExpertSampling regarding the use of our platform and services.
ExpertSampling provides market research services including qualitative research, quantitative surveys, data analysis, and panel recruitment. Services are provided on an as-requested basis, subject to scope agreements and statements of work (SOWs) between ExpertSampling and the client.
All services are designed in compliance with ESOMAR 37 standards and industry best practices for ethical market research.

ExpertSampling retains ownership of its research methodologies, platforms, tools, and technologies. Clients receive a license to use deliverables (reports, data, analysis) for their internal business purposes only. Clients may not resell, republish, or sublicense research deliverables without explicit written consent.
Respondents retain rights to their personal information; ExpertSampling retains rights to anonymized, aggregated research data for benchmarking and secondary research purposes.
ExpertSampling guarantees a minimum 97% data quality rate across all studies. If delivered data falls below this standard, ExpertSampling will either:
Data quality metrics include response authenticity, profile accuracy, and completion integrity. Claims must be filed within 30 days of data delivery.
Pricing is detailed in project-specific Statements of Work and quotations. Payment terms are typically net 30 days from invoice. ExpertSampling reserves the right to suspend services if payment becomes overdue. Rush delivery and custom methodologies may incur additional fees.
Most research projects launch within 48 hours of confirmation. Timelines vary based on sample complexity, incidence rates, and geographic distribution. ExpertSampling commits to reasonable efforts to meet agreed-upon deadlines; however, extended recruitment timelines or participant attrition may require timeline adjustments. Force majeure events may delay delivery.

Services are provided "as is" without warranties of any kind, express or implied. While ExpertSampling maintains high quality standards, research data may contain sampling error, respondent bias, or other limitations inherent to survey methodology. ExpertSampling does not warrant that services will be uninterrupted or error-free.
Both parties agree to maintain strict confidentiality of proprietary information shared during engagements. For extended or sensitive projects, formal Non-Disclosure Agreements (NDAs) may be required. Data belonging to one client will not be shared with competitors without explicit consent.
Disputes arising from these terms shall first be resolved through good-faith negotiation. If resolution fails, disputes may proceed to binding arbitration in accordance with the International Chamber of Commerce (ICC) Arbitration Rules. Legal venue shall be determined based on the client's jurisdiction.

ExpertSampling reserves the right to modify these Terms at any time. Changes will be effective upon posting. Continued use of our services constitutes acceptance of updated terms. We recommend reviewing these terms periodically.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
These Terms of Service are governed by and construed in accordance with applicable laws in the United States, without regard to conflict of law principles. Clients in other jurisdictions agree to comply with applicable local laws regarding research ethics and data protection.
ExpertSampling is committed to ESOMAR 37 standards for ethical market research. All research is conducted with respect for respondent privacy, data security, and informed consent. Clients must similarly commit to ethical research practices.
